Terms and Conditions for BIG POT Energy

1. Acceptance of Terms

Welcome to BIG POT Energy ("we," "us," "our"). By signing up for our lottery group services ("Service"), you ("User," "you," "your") agree to be bound by these Terms and Conditions. Please read them carefully.

2. Eligibility

You must be at least 21 years old to use our lottery group services. By registering, you confirm that you meet this requirement and that you agree to these Terms.

3. Registration and Account

To use our services, you must register for an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your account. You agree to accept responsibility for all activities that occur under your account.

You must be at least 21 years old and legally able to participate in lottery activities in your jurisdiction to use our service. Every person who signs up must accept these Terms, including the allocation of responsibilities between BIG POT Energy and Group Organizers described in Sections 4 and 5.

4. Nature of the Service

BIG POT Energy provides an online tracking and reporting service for lottery groups. The service lets a group organizer purchase a group for a chosen number of members and duration, invite members, record each member's number selections, upload photographs of purchased tickets and view reports comparing the group's recorded numbers with official drawing results.

BIG POT Energy does not purchase lottery tickets, hold or collect member contributions, claim prizes or distribute winnings for user-created groups. The service fee paid to BIG POT Energy covers the tracking and reporting service only.

5. Group Organizer Responsibilities

The person who creates a group (the "Group Organizer") is solely responsible for:

• collecting any contributions or fees from the members of their group; BIG POT Energy is not involved in and is not responsible for the collection of member fees;
• purchasing the lottery tickets for the group and uploading photographs of those tickets to the group for the members' records;
• verifying results, claiming any prizes and distributing winnings among the members of the group in accordance with whatever arrangement the group has agreed;
• managing the membership of the group, including removing members. When a member is removed, the reason provided by the Group Organizer is emailed to the removed member;
• complying with all laws applicable to lottery play and prize sharing in their jurisdiction.

By creating a group, the Group Organizer confirms that they accept these responsibilities. By joining a group, a member acknowledges that their Group Organizer, and not BIG POT Energy, is responsible for fees, tickets and winnings, and that any dispute regarding fees, tickets or winnings is between the member and their Group Organizer.

5C. Equal Sharing of Winnings and Playing with People You Trust

By joining a group, each participant agrees that any winnings from tickets purchased for that group are shared equally among all participants of the group who were active members for the drawing concerned, regardless of whose recorded numbers produced the prize. The Group Organizer (or a co-organizer appointed by them) holds the tickets, claims any prize and distributes the winnings accordingly. BIG POT Energy records this agreement when a member joins but is not a party to it and does not enforce it.

Only play with people you personally know or trust. Group membership is by invitation from the Group Organizer. BIG POT Energy does not verify the identity, honesty or solvency of any Group Organizer, co-organizer or member, and is not responsible for any loss arising from the conduct of a group's participants.

A Group Organizer may mark a drawing as skipped when no ticket was purchased for it; skipped drawings are excluded from the group's reports. Members receive an email after each drawing with their recorded numbers, the official results and a to-date summary for the group; these emails are informational only.

5A. Group Purchases and Fees

A group is purchased by one person for a selected number of member seats (for example 5, 10, 15 or more) and a selected duration. The price is calculated from the number of seats and the duration and is shown before payment. Group service fees are non-refundable once the group has been activated, except where required by law. BIG POT Energy may change group pricing for future purchases at any time.

All payments are processed securely through our payment processors. We do not store your complete payment information on our servers.

5B. Reports and Accuracy

Reports are generated from the numbers recorded by members and the drawing results imported from official public sources. Prize amounts shown in reports are estimates based on the standard Powerball prize table and are for information only. Members must rely on the physical tickets held by their Group Organizer and on the official lottery results for any claim.

6. Winnings and Taxes

All winnings are subject to applicable tax laws. Members are responsible for reporting their share of winnings to relevant tax authorities and paying any applicable taxes. The Company may provide tax documentation for significant winnings as required by law.

7. Limitation of Liability

To the maximum extent permitted by law, BIG POT Energy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, resulting from your access to or use of or inability to access or use the services. Without limiting the foregoing, BIG POT Energy is not responsible for any lottery ticket that a Group Organizer fails to purchase, for any contribution a member fails to pay or a Group Organizer fails to collect, or for the distribution of any winnings within a user-created group.

8. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including without limitation if you breach the Terms. Upon termination, your right to use the service will immediately cease.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our service after those revisions become effective, you agree to be bound by the revised terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.
